It can be stressful for a business owner to think about trying to steer through the labyrinth of FDNY fire safety regulations. There are so many requirements to be approached, and it may seem like there will always be that one thing that we forget to do. One subset in the realm of fire safety is fireproofing. The FDNY expects that ornamental items or items used for aesthetic enrichment on business properties be soaked or sprayed with flame retardants if they are not otherwise inherently flame resistant. A business owner must be able to prove that these conditions have been met by receiving a valid affidavit. There are 2 different categories of obligations, and today we are discussing the affidavit that is required for items that are inherently flame-resistant.
For this particular kind of affidavit, the articles referenced here are ones that already meet the NFPA (National Fire Protection Agency) 701 demands and are not obligated to be treated with fire retardants. For these individual items, the business owner will need to file this particular affidavit with the Bureau of Fire Prevention. For the document to be credible, it needs to be signed by a C-15 Certificate of Fitness holder (like Certified Flameproofing), and it must declare that every piece of decoration or scenery is inherently flame resistant. This document should be registered with the Bureau within 10 days of the items being showcased, and the business owner also is required to keep a copy at the business location as well.
So what is the Bureau of Fire Prevention expecting to see on this document, to guarantee that it is authentic?
It should have the name of the person who personally examined the items and gave his approval, along with his C-15 Certificate of Fitness number and the date of expiration. As well, the certificate should have the name of the company who designed the items. A specific description of the items must be present as well as a written explanation of the materials' qualities that cause it to be inherently non-combustible.
For the FDNY to accept this documentation, the objects listed must be in compliance with their regulations. If they're not, the FDNY will contact with the business owner as well as the Certificate of Fitness holder, in writing, and detail why the objects in question do not meet their criteria. Consequently, the business owner will be required to remove that item from the location, and it cannot be reinstalled again until it has been properly flameproofed. After this happens, a new and distinct affidavit of flame-resistant treatment (different from the inherently flame-resistant affidavit) will be given, and it must be filed with the FDNY.
We know it seems like a lot of effort to expend to navigate through the technicalities of FDNY requirements, but the degree of fire safety that fireproofing offers makes it a task that is in everyone's best interest. It requires even more effort to fix a circumstance where a business property is non-compliant.
